What is a class action lawsuit?

A class action lawsuit is a lawsuit filed by one or more plaintiffs on behalf of others who have a similar legal claim. Because they allow people to join together as a group in a single lawsuit against one or more defendants, class action lawsuits provide an economical and efficient method to recover monetary damages caused by others' wrongdoing. Class action lawsuits also encourage more responsible behavior on the part of corporate defendants.

Now let’s get to the important part - some current class actions from which you may be eligible to receive compensation:

1. Provigil, Nuvigil, and generic modafinil Class Action Settlement

This lawsuit was brought against a number of Defendants including Cephalon, Inc., Teva Pharmaceutical Industries, Ltd., Teva Pharmaceuticals USA, Inc., Barr Pharmaceuticals, Inc. (collectively, “Cephalon”), Mylan Pharmaceuticals Inc. and Mylan, Inc. (formerly known as Mylan Laboratories, Inc.) (collectively, “Mylan”), and Sun Pharmaceuticals Industries, Ltd., as successor in interest to Ranbaxy Laboratories, Ltd. and Ranbaxy Pharmaceuticals, Inc., (collectively “Ranbaxy”) and alleges that defendants violated state antitrust and consumer protection laws relating to the sale of the pharmaceutical medication Provigil. While both parties have reached an agreed upon settlement of $48 million, the defendants maintain their denial of any price fixing allegations.

Who is eligible:

- Individuals who purchased Provigil between June 24th, 2006 and August 8th, 2019 while a resident of one of the eligible states. Eligible States include: Alabama, Arizona, California, District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Kentucky, Louisiana, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Nebraska, Nevada, New Mexico, New York, North Carolina, North Dakota, South Dakota, Tennessee, Utah, Vermont, West Virginia and Wisconsin.

2. Spectracide Concentrate Settlement

This case was brought against United Industries Corporation (UIC) for alleged improper marketing of their Spectracide Concentrate Herbicide products. According to the complaint, UIC falsely labeled their weed killer "concentrates" as able to make the advertised number of gallons of weed killer. Once added to water, per the instructions, each bottle of concentrate was supposed to make the advertised amount of the properly diluted weed killer. But after an investigation by consumers, it was discovered that the bottles were falsely labeled and were unable to produce the advertised amount of weed-killing solution. While UIC denies that it mislabeled its products and claims that consumers did not pay any more because of any misleading or deceptive advertising, they have reached a settlement agreement to reimburse anyone who purchased their concentrate products between September 21, 2013, and November 1, 2019.

Who is eligible:

- Individuals who purchased any of the Spectracide® Concentrate herbicide products between September 21, 2013 and November 1, 2019.

3. Nissan Transmission Class Action Settlement

This case was brought against Nissan on behalf of owners and lessees of vehicles that were built with variable transmissions. According to the plaintiff's complaint, the Class Vehicles have a defective continuously variable transmission ("CVT") which can lead to poor transmission performance or failure. Because of the faulty part, Nissan allegedly breached their expressed and implied warranties, unjust enrichment and violated a number of state consumer protection statutes. Both parties agreed to a settlement to reimburse class members for the faulty part and damages that resulted from the faulty transmissions.

Who is eligible:

- Individuals who owned or leased a qualifying 2013-2017 Nissan Sentra, 2012-2017 Versa or a 2014-2017 Versa Note while a resident of the United States.

Claims-filing deadline: 1/30/2020 or 30 days after a qualifying transmission repair, whichever is later
Potential award: Up to $4,750 in reimbursements

4. Yahoo Data Breach Settlement

This case was brought against Yahoo! Inc. and its small business provider, Aabaco Small Business, LLC on behalf of individuals impacted by various data breaches that occurred between 2013 and 2016, as well as data security intrusions that occurred in early 2012. Plaintiffs allege that Yahoo! and Aabaco failed to adequately protect their personal information. Both sides have agreed to a settlement in the amount of $117.5 million.

Who is eligible:

- Individuals who had an email account through Yahoo or other Yahoo websites (which includes sites such as Yahoo Sports, Tumblr, or Flickr) between Jan. 1, 2012 and Dec. 31, 2016

5. Auto Parts Settlement

This settlement came from an alleged conspiracy amongst the largest manufacturers in the automotive industry to fix prices, rig bids, and allocate markets and customers in the U.S. that violate federal and state antitrust laws. Several rounds of settlements have already been approved by the courts.

Who is eligible:

- Individuals who bought or leased a new vehicle since 1990

- While a resident of AZ, AR, CA, DC, FL, HI, IA, KS, ME, MA, MI, MN, MS, MO, MT, NE, NV, NH, NM, NY, NC, ND, OR, RI, SC, SD, TN, UT, VT, WV, or WI

Claims-filing deadline: The deadline to file has been extended to 03/16/2020
Potential award: $100 or more

6. Gap & Banana Republic Settlement

This case was brought against Gap (which includes Gap Outlet, Gap Factory Store and Banana Republic Factory Store) who allegedly used false or misleading reference prices. While denying all allegations, Gap reached a settlement with the Court to refund eligible class members. The settlement refunds class members for any refunds or credits they failed to receive following purchases within the established timeframe.

Who is eligible:

- Individuals who made an in-store or online purchase at Gap Outlet, Gap Factory Store or Banana Republic Factory Store between May 24, 2010 and May 10, 2019

- And have not received a refund or credit for all purchases

7. Equifax Data Breach Settlement

This settlement resolved the class action against Equifax, a consumer credit agency, for the data breach they experienced back in 2017. The breach led to the access and extraction of 147 million U.S. customer's personal information by an outside group, including customer's names, social security numbers, addresses, birth dates and in some cases even driver’s license numbers. Equifax denies any wrongdoing, and according to the settlement no judgment or finding of wrongdoing has been made. The settlement reached by the Court will compensate consumers for their time and money lost as a result of the data breach.

Who is eligible:

- Individuals whose data was stolen from Equifax (click here to find out if your data was stolen)

Potential award: $125 to $20,000 depending on severity of loss
